These Terms and Conditions ("Agreement") set forth the policies, responsibilities, and relationship between Whirled Away Travel LLC ("we," "our," "us") and you ("Client," "you," "your") in connection with our personalized travel advisory and planning services.

 

1. Scope of Services

Whirled Away Travel LLC provides travel advisory and planning services including customized destination recommendations and itineraries, booking support for accommodations, transportation, tours, and activities, and optional booking of third-party services upon request. We act as a travel advisor and facilitator. While we may assist in coordinating third-party services, we are not a travel supplier and do not operate any travel services ourselves.

 

2. Client Responsibilities

By engaging Whirled Away Travel LLC, you agree to:

• Provide complete and accurate personal and travel information in a timely manner.

• Review all documents, confirmations, and itineraries for accuracy.

• Ensure that you and all travelers in your party have valid passports, visas, vaccinations, and other required documentation.

• Understand and comply with the terms of any third-party travel providers.

• Ensure that you and all travelers in your party are legally permitted to travel. This includes, but is not limited to, having no legal restrictions such as parole, probation, pending legal matters, or other conditions that may limit domestic or international travel. Whirled Away Travel assumes no responsibility for travel interruptions or denials due to legal restrictions or governmental limitations.

 Failure to comply may result in itinerary cancellations, changes, delays, or added fees.

 

3. Advisory Fees

Advisory fees (if any) will be discussed before services begin. Fee structures may include:

• Trip Planning Fee (flat rate or per traveler)

• Booking Coordination Fee

• Last-Minute Planning Fee (for trips booked within 14 days of departure)

Note: Advisory fees are non-refundable once research or planning work has started.

 

4. Payments

• Payments are due per the invoice schedule provided.

• All payments must be made by credit or debit card.

• Late payments may incur a 5% monthly service charge.

We reserve the right to pause or cancel services if payment is not received on time.

 

5. Cancellations and Refunds

a. Client-Initiated Cancellation

You may cancel our services at any time by calling 484-438-2929 or emailing us at hello@whirledawaytravel.com. Refunds of advisory fees follow this schedule:

• If cancelled before planning begins: 50% refund of advisory fee

• If cancelled after planning has begun: No refund of advisory fee

• If cancelled after itinerary has been delivered: No refund of advisory fee

Any refunds or changes to services booked on my behalf with third-party providers (airlines, hotels, tours, or other suppliers) must be requested directly with those providers and are subject to their terms.

b. Cancellation by Whirled Away Travel LLC

We reserve the right to cancel services, including deactivation of travel portal and app, due to non-payment, abuse, or violation of these terms. In such cases, no refund will be issued.

 

6. Revisions and Changes

One round of itinerary revisions is typically included in your package unless otherwise noted. Additional changes or re-bookings may incur additional hourly or flat fees. Significant itinerary changes after confirmation may result in third-party change fees.

 

7. Third-Party Vendors

We may recommend or book services through independent third-party suppliers (e.g., airlines, hotels, tour operators). Whirled Away Travel LLC is not responsible for:

• Changes in availability, price, or service from third-party providers

• Their terms, conditions, or cancellation policies

• Losses, damages, or dissatisfaction resulting from their services

It is your responsibility to review and accept third-party terms.

 

8. Travel Insurance

We strongly recommend comprehensive travel insurance that includes cancellation, trip interruption, medical coverage, baggage loss, and more.

You acknowledge that Whirled Away Travel LLC advises that you purchase travel insurance. Declining insurance is done at your own risk.

 

9. Force Majeure

Whirled Away Travel LLC is not liable for disruptions or cancellations caused by events beyond our control, including but not limited to:

• Weather events, natural disasters

• Public health emergencies or pandemics

• Government travel restrictions

• Political unrest, terrorism, or war

 

10. Limitation of Liability

To the fullest extent allowed by law, the total liability of Whirled Away Travel LLC for any claim shall not exceed the amount paid to us for advisory services. We are not liable for:

• Missed flights, delays, or cancellations

• Third-party failures or errors

• Financial losses or inconvenience

 

11. Privacy

Your privacy matters to us. Personal information will only be used for trip planning and shared with vendors as needed to complete bookings. We will not sell or disclose your information to unaffiliated third parties without your consent.

 

12. Governing Law

This Agreement shall be governed by the laws of the State of Pennsylvania, without regard to its conflict of law provisions. Any disputes shall be resolved in the appropriate courts of Chester County, PA.
